We provide financing against single cases either to fund the cost of running a piece of litigation or as a capital release for plaintiffs and claimants.

Single case funding consists of funding the legal costs of a litigation or arbitration matter, or buying a single award to enable cash flow for a claimant, as well as purchasing insolvency claims.

Law Firm Financing

Client attitudes to the billable hour have shifted and law firms are under ever more pressure to provide flexible fee arrangements where the firm assumes some of the financial risk of a dispute. Smaller law firms often lack access to the required finance to pursue and sustain costly litigation, while larger law firms may be reluctant to accept the risks associated with a major investment.

Bench Walk Advisors provides single-case and portfolio facilities to enable leading law firms the opportunity to broaden their financial bandwidth and compete for more cases. Single cases carry binary risk and therefore pricing reflects this, while portfolio facilities allow risk to be spread across a law firm’s book of disputes bringing the cost of the facility down.

Corporate Portfolio Financing

The soaring costs of running a dispute can significantly limit a company’s ability rigorously to assess and pursue meritorious disputes, particularly if they involve tying up their balance sheet that could more effectively be deployed for their core business. This sometimes means promising claims cannot be pursued.

A Bench Walk off-balance sheet, non-recourse portfolio facility is provided directly to the corporate client to cover or reduce the costs of pursuing disputes or to monetize claims. The client is able to free up cash flow and turn disputes into assets, thereby improving EBITDA and corporate valuations, while increasing its capacity to bring more meritorious claims.

Defense Funding

Financing can make good economic sense for the defendant, provided the product is properly structured. Bench Walk Advisors is one of the only funders globally to offer a product for defendants.
